The U.S. administration has leveraged two key trade law enforcement authorities to impose tariffs in 2025:

  • The International Emergency Economic Powers Act (IEEPA)
    Authorises the President to "regulate" certain economic transactions, including imports, in response to declared emergencies concerning certain "unusual and extraordinary" threats to national security, foreign policy or the economy.
  • Section 232 of the Trade Expansion Act of 1962 (Section 232)
    Authorises the President to impose import restrictions—such as tariffs—if the Secretary of Commerce determines a product "is being imported into the United States in such quantities or under such circumstances as to threaten to impair the national security."

  • Executive orders and fact sheet issued exempting goods from Canada and Mexico that satisfy USMCA rules of origin requirements.
  • Tariff lowered to 10% for non-qualifying USMCA energy products from Canada and non-qualifying potash from Canada or Mexico.
12/3/2025 Section 232 (steel & aluminium) All Steel and aluminium
  • 25% tariffs on steel and aluminium (including derivatives) imported from all countries go in effect.
26/3/2025 Section 232 (auto & auto parts) All Automobiles and auto parts
  • Proclamation and fact sheet issued imposing 25% tariff on automobiles and certain automobile parts, effective for automobiles on 3 April, 2025 and no later than 3 May 2025, for auto parts.
  • Special tariff exemptions for USMCA-compliant auto parts and for the value of US content embedded in autos imported under USMCA.
2/4/2025 IEEPA (fentanyl migration) China All goods
  • White House issues fact sheet and amends executive orders from 1 February and 5 February to end de minimis treatment for low-value deliveries from China, effective 2 May 2025.

  • 10% baseline tariff announced for most countries, effective 5 April 2025.
  • Country-specific tariffs to go into effect 9 April 2025, for countries listed in Annex 1 of the executive order.

  • The 84% country-specific tariff on all goods from China increased to 125%, effective 10 April 2025.

  • The 125% country-specific tariff on all goods from China in effect.
  • Both the IEEPA fentanyl tariff of 20% and country-specific tariff of 125% apply to all goods imported from China for a total of 145%.

  • Memorandum issued excluding certain semiconductors, smartphones and consumer electronics from the tariffs announced on 2 April, 2025.
29/4/2025 IEEPA; Section 232 All All goods; steel & aluminium; auto & auto parts
  • Executive order revising if and how certain tariffs are to be cumulatively applied and outlines a procedure to determine which tariffs are to apply to imports that are subject to multiple tariff actions.
  • Proclamation issued providing a partial credit for auto parts based on the value of a manufacturer’s U.S.-built vehicle.

  • De minimis treatment for all low-value deliveries imported from China ends.

  • 125% tariff on goods from China lowered to 10% for a 90-day period (until 12 August 2025), after which time the 10% tariff will increase to 34%.
  • Both the IEEPA fentanyl tariff of 20% and country-specific tariff of 10% apply to all goods imported from China for a total of 30%.

  • 10% tariff on goods from China remains unchanged and will increase to 34% on 12 August, 2025.
30/7/2025 IEEPA (trade deficit) All All goods
  • Executive order and fact sheet issued suspending de minimis treatment for deliveries from all countries, effective 29 August 2025.
  • Exceptions: International postal deliveries will continue to be duty free. If they are delivered by transportation carriers, they will be subject to duties based on the methodology outlined under Section 3 of the executive order.
30/7/2025 IEEPA (foreign threats) Brazil All goods
  • Executive order and fact sheet issued imposing a 40% IEEPA tariff on imports from Brazil, effective 6 August 2025.
  • Tariff stacking: Both the 40% foreign threats tariff and 10% IEEPA reciprocal tariff apply, totaling 50% for goods from Brazil. Applicable Section 232 tariffs do not stack.
  • Exceptions: Goods listed in Annex I of the executive order or 50 U.S.C. 1702(b) are not subject to the additional tariff. In-transit exception: See details outlined in Section 2 of the executive order.
  • Foreign Trade Zone: Must be entered as "privileged foreign status".
30/7/2025 Section 232 (copper) All Semi-finished copper and intensive copper derivatives
  • Proclamation issued imposing 50% tariffs on semi-finished copper and intensive copper derivatives, effective 1 August 2025.
  • Tariff stacking: Copper content subject to the Section 232 tariffs is not subject to the IEEPA reciprocal tariffs; non-copper content is subject to the IEEPA reciprocal and fentanyl tariffs. Goods subject to the Section 232 auto/auto parts tariffs are not subject to the Section 232 copper tariffs.
  • Foreign Trade Zones: Entries must be entered under “privileged foreign” status.
  • Drawback: Not available for copper tariffs.
31/7/2025 IEEPA (fentanyl migration) Canada All goods
  • Executive order amended increasing the 25% IEEPA fentanyl tariff to 35% for non-qualifying USMCA goods imported from Canada, effective 1 August 2025.
  • Transshipments: 40% tariff replaces the 35% tariff if goods are found to have been transshipped to avoid the additional tariff and do not qualify for USMCA.
  • Energy products remain at 10% and potash that does qualify for USMCA remains at 10% for imports from Canada.
31/7/2025 IEEPA (reciprocal) All All goods
  • Country-specific tariff rates adjusted for most countries, effective 7 August 2025.
  • Transshipments: Goods found to be transshipped to avoid the reciprocal tariff will be subject to a 40% tariff.
  • 10% “baseline” tariff applies unless replaced by a country-specific tariff.

  • Exceptions: Goods listed in Annex ll of the executive order or 50 U.S.C. 1702(b) are not subject to the additional tariff. In-transit exception: See details outlined in Section 2(b) of the executive order.
  • Foreign Trade Zone: Must be entered as “privileged foreign status.”
7/8/2025 IEEPA (reciprocal) All (except Canada & Mexico) All goods
  • Country-specific tariff rates listed in Annex I of the executive order from 31 July 2025, go into effect.
  • 10% tariff remains for countries not listed in Annex I of the executive order.
